Hello Everyone!

Well I spoke to the City Prosecutor like one of you said and also
consulted with my lawyer. Both said this case is extremely simple
and can be handled in a terse fashion.

Tree Company agreed (although reluctantly) to pay the $5000
after I:

1) showed them documents that the tree WAS healthy
2) Proving that I was not present and this was done without consent
3) A complete mess left in my yard
4) Fee and time for removing the mess
5) Lost wages due to this

Tree company didn't want to take this to court.

(My other good neighbors also came along to give evidence against
the neighbor.)

However, a court date was still scheduled for the 12th where the neighbor
didn't bother to show up. My lawyer and I showed all evidence
(tree company gave a copy of the info on the date of cutting
that my neighbor was the perpetrator)

and my lost wages, fee for cleanup, loss of shade,
records of the tree being healthy etc. which I mentioned before.

Judge said this was very simple and granted me the $5000 which the neighbor was ordered to pay.
This was indeed fast and I am thankful for it.

and I have no desire of even looking at him.

Poster, I'm glad it worked out. Fricking insane neighbors anyway!!!!

Maybe with your money you can buy a new tree.

The moral here, dogstooth's advice to see the prosecutor; and my advice to see an attorney, are both truths and both effective. Proof positive that there is more than one way to skin a cat.

Now, has anybody seen that weasel that was holding my coat?

I went looking for him everywhere and now even the mulberry tree he was standing next to is gone.

I'm stumped... :confused: (get it? Stumped?) - LOL

O.K., so I admit that I have been having a run of bad luck lately. But this takes the cake.

Just when I think that I am gonna get to come into some good Arkansas swampland; I get weasled out of that too.

HOAX? Yeah, I wish. I'd still have the tree around and I certainly wouldn't be typing all this. DUH.

Obviously I can see you have never experienced anything near this.
Also, the tree company payed the $5000 without taking this to court.

As for the neighbor paying the other $5000, any idiot would be able to see
with proven documents the damage he inflicted upon my property -
and that a decision CAN be quickly made.

To those that are envious and can't stand another's success - Sorry for posting.

But thanks to the many (for the last time) that actually gave thoughtful advice.
 
Smart tree company there is no doubt. They would have lost time, AND the money. Plus the costs of the suit. If incorporated even moreso. Smart tree company.

Howzat feel, being treeless yet richer? :D
