So then what is your defense? Do you honestly think I am posting from the side of the road? I don't need to look up the definition of libel per se, I know what it means, and although you do not need to show actual damages with libel per se, you still must show that the dafamatory language identified a particular person. Since this entire site is anonyms, I don't think either one of our libel suits would go very far. As far as the operator of this site is concerned, I don't think they run background checks on everyone who calls themself an attorney. Quite frankly, I really don't care what you do for a living, but we have gotten so far off the OP concerning a MetroCard that I really do think we should put this thread to bed. And one more thing...NO ORANGES FOR YOU! Oh and for Enasni: NO NARANJAS PARA TU!

YAG, in case it got lost in the back-and-forth, could you comment on my earlier statement: "Ahhh. Makes sense. Practically, Mens Rea is absent from SL Crimes, but technically it's there...?" Is MR contained in SL Crimes in a kind of technical sense. If not, then here's the point that keeps tripping me up: Doesn't US Law require that a crime have MR? If so, how is SL crime considered a true crime? Is it simply that there's another statute that sets it out somewhere else? If so, wouldn't these two statues seem to contradict each other? I guess that's why I keep coming back to "technically MR exists". I've also read in a few places where MR isn't entirely removed from SL Crim, but that it's been basically pre-established in the actual commission of the act to facilitate prosecution of the crime. To me, that would suggest that intent is present, albeit in a drastically reduced form. One reason for my dogged persistence is that realize law is VERY specific and cases can actually hinge on the word "is", so I guess that's why I'm confused because it seems like there's some kind of contradiction here. I guess I'm not so much disagreeing with you anymore and tripping over an apparent contradiction.

jkruler, perhaps to silence some of the vitriol, could you post what your profession is? You said something about being "on vacation", so are you perhaps a lawyer too? Just curious. Even if you DO sell oranges on the street , it wouldn't have any bearing on how much weight I place on your arguments. (One of the smartest people I ever met was a homeless man I bought lunch for once. Absolutely brilliant (sad story too ))

Point of clarification: I have two Masters. Perhaps you misread? No, surely not. Maybe I did a mid-sentence edit and used the wrong tense. Yeah, that's probably it. You surely couldn't have read it wrong. That would mean you did the same thing you accused me of in the other thread. That would make you a hypocrite. No, currently, I'm getting ready to begin an education doctorate (though at one class a term, it's gonna go slow. Still, "Dr." before 40 has a nice ring ) And yes, I took Greek and Hebrew (the latter was, quite possibly, the hardest course I ever took. Not sure what law school classes are like, but Biblical Hebrew was a kick in the jimmy.)

You may have insults, but you also seem to stay to your own threads and not meander around.
There are lawyers, judges, cops, Doctors, forensic specialists, real estate agents, insurance agents, Human Resource professionals, bankers and I think a hidden IRS agent besides the unsung others who take their FREE time and assist. They are not all biased, they listen they help and they do it on their own time.

Let me put this as simply as I can. Maybe you'll get it then. I stick to the threads I'm on because they're the ones that interest me. I have gone to several threads and given what useful advice I have. On this thread, a VERY interesting discussion (to me) about MR ensued, so I followed it. All was well and I was learning something. Then lo and behold, of no action on my part, rmet (and now you) jump in and "keep the troll alive". If you feel left out of the discussion, by all means jump in. If you're just here to troll, do that too if it floats your boat. The former is educational and I welcome it. The latter is simply amusing and, since it makes me laugh, I guess I welcome it to. As for why YAG decided to have something to do with me, I dunno, but he/she did and apparently it's really bothering you. Seeing as how both you and rmet haven't even been here for a year (you don't even have 6 months), I'm not really inclined to care a great deal about what you say. Heck, if nothing else, the whole "Stonehead" thing is so 3rd grade, it only serves to further eliminate any shred of credibility you might have. At least come up with something original. I enjoy this forum and I think I'll stay. If you don't like that, tough.

Now, by all means, respond with another ?clever? attempt at an insult. My wife was curious last night and read some of these posts and now she's getting a kick out of it. In fact, she appreciated the fact that I had gotten online to try and find out how best to proceed to fix her car so much that she went ahead and gave in when I asked for a new bike (and she had a great time reading all your posts. Thought they were very "elementary school"). So you see, you guys are actually helping me by following me around and posting where I post.
