In my correspondence with the agent, I have sent actual copies of their own paperwork back with my correspondence highlighting my points, or the points of interest. In my last paperwork received, they come up with a monthly total of 543.77 which by now understanding somewhat they're way of thinking, Should be correct.

My paperwork, signed judgment, divorce papers all say the samething,

125 per week 250 every two

Can't win for losing in this system.

Weekly amount not monthly amount correct?

Then I would be safe to say that you aren't the only one in this situation. Anyone with a written and signed order is going through the same thing.

When was your judgement signed?

The amount of your arrears is approximately for 9 months. Had the FOC input the monthly amount of 543 originally then you would be in arrears more than what you are. They have been calculating your child support at the amount set by the original judgement until about 9 months ago. Which kind of goes back to their new computer system.

Write the letter as I suggested and see what the outcome is.

Hi again. Thanks for your time and support in this manner. Had I understood how FOC calculates for the year, I would not have bothered you, but again thank you for your time and I will adjust the amount HR is taking out to reflect the true amount.

One final thought…. It is my understanding from my divorce paperwork that the order is based on a weekly amount and not a monthly. Is it too late to request at what date FOC changed the amount being charged to my account from 125 per week to the monthly amount? I am sending copies, which shows that it is based on a weekly amount and not a monthly, and where the bi-weekly (which I am paid for the time period in question) states $250.00.

Honestly? No. You are admitting that you were wrong. You weren't wrong until they changed their system. The amount that was being deducted from your check until approximately 9 months ago was correct and you were not charged arrears.

Give me a minute or 7 and I will see if something else will do that you agree with.

In regards to the above case number I am inquiring as to when the amount showing in your computer system was changed from the original divorce decree dated xxxxxxx to what is now showing in your computer system. I am attaching a copy of the original order, as well as your order to my employer for the amount to be deducted. It appears that my employer had been following your order to deduct a bi-weekly amount of $250.00 and that amount had been accepted since xxxxxx, with no arrears accruing.

Any information that you can give me to the change in the original court order and your written requirements would be appreciated.

You can change anything you want to add, but I think this will give you the answers you need to justify why 9 months ago you have been accruing arrears and you weren't for almost 2 years.

Its the same way here in Delaware. Ex husband is ordered to pay $50.00 per week, but the actual amount is 223.17 per month. He hasnt paid for a month, so i am taking him back to court. They weren't going to let me bc he has to be three months consecutive with partial and/or missed pmts. So he's been making partial pmts the whole time. Hi ho hi ho, its back to court we go.

If you pay $250 a paycheck, and you get paid bi-weekly, you're paying $6500 a year, which is, imagine that, $125 a week. There are two times a year when you get a third paycheck in the month. This year, i think it's july and october. if your payroll dept DOESNT take out those two $125 payments, that would put you in arrears by $20.83 a month.

if you haven't done this already, get a copy of all the payments you've made from your payroll dept, and look at wayne county's website, they may have a payment history available online (maricopa county does and it's been a lifesaver for my husband's disputes) or you might be able to call Family Court and ask them for a payment history. If you have paid $6500 a year since 2002, you shouldn't owe arrears. don't lose sight of this-- $125*52/12= $541.67, which is still $250 a paycheck. if that's what you've been paying, that's all you owe.

He stated himself it has a different amount listed for weekly, bi-weekly, semi-monthly, and monthly pay. It was up to the employer to use the right figure for what type pay he had. Bi-weekly and semi-monthly is two very different things and can make huge differences. Anyone in banking or finance has experience in many of these, the HR department should have known this. Also anyone paying child care should have known this as you pay child care by the week. Some months I have to pay an extra 200.00 for my two children because of that even though I am paid semi-monthly.

Well I have heard back from the officer that I have a correspondence with and with the letter and submitted paperwork, they have adjusted the amount to being only approximately 250 dollars which is a more logical amount. This lady at FOC has just been wonderful and patient and willing to help.
