Story....

Roof Leaking For 4-5 years
Complaining Tenants / Getting No Repairs
Last Year Roof Repaired / Loads Of Mold Found In Attic Area
Mold Test "Positive" In Some Areas Up To 4 Feet Up The Inside Of Wall.
LandLord Called To Fix Issue / Shows Up With Un Marked Can Of Spray Something. When Asked What Contents are Told Not To Worry About "IT".
Threatend To Take To Court If Repairs Were Not Done Properly.
Got Evicted.

After Some Research,

We founf out that the "property owner" Does not own the property. Well that is as far as the county records show. SO after further research we found the owner " according to the county records" and he stated that he sold the property back in 1967/68. He informed us that we could stay as far as he was concerned.

After even a little more Research we find out that "the property owner" has another house that he has been collecting rent from for atleast 20 years. He is not listed as the owner of that property as well.

At a local level we have had no luck with getting anything done. Who or where should we turn, do we have any ground to stand on? Any Help or Ideas would be great.

What does your "research" tell you about who this alleged LL was in relation to the actual property owner? Perhaps he is a friend or family member of the owner? In that case, he may only need to have the actual owner's authorization to manage his property for him.

Oh, and for California, that also means that the person may also need to be a licensed real estate broker to perform property management duties:

Businesses and Professions Code, Chapter 3, Article 1, Sec. 10131(b).
A Real Estate broker's license is required for any person or company that, for compensation, leases or rents or offers to lease or rent, or places for rent, or solicits listing of places for rent, or solicits for prospective tenants, or negotiates the sale, purchase or exchanges of leases on real property, or on a business opportunity, or collects rents from real property, or improvements thereon, or from business opportunities. A salesperson working under a broker may engage in such activities.

According to the Owner from 1968, he sold the property to our LandLord back then. There is no relations.

What good do you think it does you to cite that someone who doesn't own the property said you could live there?

You say the OWNER (yes, the owner, he bought it from the previous owner)/landlord was a bad landlord. You have complaints going back for years. You have been evicted.

Move, and get on with your life.

What purpose do you hope to achieve? Sounds like you are wanting to use mold as a reason to either gain money from LL or get money from past rent. On either subject ,you will lose.

One thing, you need to start a paper trail of what you are wanting to have fixed.
Another thing, what purpose do you hope to achieve by checking records? If he is collecting rent and you have not sent a reg letter of complaints, than why search for the owner? As stated he might represent the owner. AFTER the letters and no response THAN search for the owner and start the paper trail there.

To find out who is responsable for all the damages to our property.

If he is collecting rent and you have not sent a reg letter of complaints,

We have sent letters that he has refused, also filed complains with county, still nothing has been done.

As stated he might represent the owner.

He does not represent the owner.

In your previous post (further up) you indicate it's your parents who rented this property.

I have things at my parents house. The roof leaked in my old room and in the garage. So some of my stuff got damaged. Cloths, TV, and my computer. And in the garage my father lost a bunch of power tools. I am a truck driver, so i dont live there but I still keep my stuff there.


I guess that from all the replys I have gotten everyone seems to think that there is nothing wrong with this situation. I see this is why slumlords get away with renting out property and not having to take responsibility for there crappy homes.

It's always so simple to blame the LL for conditions that the tenant willfully elects to live under year after year. Could your parents have chosen to live there due to the affordable rates?

Must not have been too bad since your own posting indicates your parents continued to live there for 4-5 years after the roof started leaking and that this seems to have become an issue only after they were evicted.

Acctually the house has been empty for 3 of the 4 years. My mother spent sometime in the hospital, with breathing / heart problums. When she got out they were staying in there moter home in the back yard waiting for the LL to fix the roof.

Yes they continued to stay on the property, but not in the house.

As for the being evicted, they were evicted after the mold issue. When my parents asked to have it fixed properly.

Yes and No, the rent was $1350.00 or something like that. They have been there 27 years, friends (neighbors) Ect. All they asked was to have the problum resolved properly, but that was asking to much in the LL mind.

The only answer is, "Did you or parents have RENTER INSURANCE?" Probably not.

All you had to do is have renters insurance, is that asking to much for renters to have? But no, as Atomizer stated, " It's always so simple to blame the LL."

Four or five years seems like plenty of time to move personal property out of the areas affected by roof leaks.

Guess that as renters you are not only to pay rent, but make repairs as well.:confused:


Answer these questions:

2) Did you have renters insurance?
3) Did the LL repair the roof? When?
4) If the property was so damaged, than why didn't you say,"All my stuff was covered in mold?" Usually, renters throw that line in.
5) Did or didn't the LL use some type of spray for the mold? Did this help? What did the spray smell like?
6) How did you know the walls inside had mold about 4 feet?
7) How did you test the mold?
8) You said test was positive, be more explicit.
