I am NCP of 2 children, one 8 one 6. The CP refuses to meet half way, because she claimes her bi-polar disorder will not allow her to drive to meet half-way, so I have to drive both ways. And yes she is court ordered to meet halfway for visitation purposes.

Ok second issue is about our 8 year old which will soon be nine. During our weekends or our summer vacation for quite some time now has consistantly soiled himself. I would inquire with my ex of the situation and she would shrug it off and say " oh the doctor says he is constipated " This issue that has been consistant over the last couple of years. The problem I have is that our 8 year old makes no attempt to even try to make it to the bathfoom, and gets upset with me when I ask what the problem is. She has said on a number of occations that it happens all the time and she just makes our child strip in the shower rinse the underwear in the tub and poke the "clumps" , with his fingers down the drain. Is this a healthy thing to teach him? What I want to know is what rights do I have or do I have any !!!

My last issue is the bi-polar problems she has. She at minimum goes in the psych ward 2-3 times a year, do to the fact she will not stay on her medications. Also when she goes off of her medications she usually ends up, one way or another, having to relocate herself and our children. So they move a couple times a year is that good on our kids?:confused:

If she is court ordered to meet you half way, and she does not, then you need to take her back to court for contempt. Now, there is some chance that a judge might find it credible that she cannot meet you half way (although I don't know why in this case) but if that were to happen then you should ask for child support to be modified based on the fact that you are incurring additional expense.

You need to be having a serious discussion with the child's doctor about this. While its not completely uncommon its still pretty rare for an 8 year old to be having this problem.

If she is ending up in the psych ward 2-3 times a year, and your children end up moving as a result....why have you NOT filed for primary custody?

Missed half that sorry. I just went back and read the whole thing,As far as meeting halfway will do that thanks! I need to know the things I am allowed to find out like school doc ect.. Do I have a shot at getting primary custody because of her mental issues? I am sure I sound horrible but I dont know the laws or my rights thats why I came here.:o

I will also add.....I think that the most misused phrase/question in the family law vocabulary is "what are my rights?".

Its not that simple, and never will be.

I think that you need a consult with a local attorney....and probably will need to hire one.

Yes, all parents have the right to full access to school records and communication with their children's teachers....as well as full access to their children's medical records and communication with the child's doctors.

If the CP has a mental illness and it is fully under control via medication/therapy etc., then no, the NCP usually can't change custody. However, if the mental illness is not under control (and three trips a year to the psych ward indicates that it is NOT) then yes, the NCP has a shot a changing custody.
