Illegal Entry aka Police Committed Breaking and Entering

what!?!?! why, are you saying like the mailroom in your building?

yes, like i said before, i saw the mail delivered on saturday, then for some reason the mail was never put into our boxes by the apartment workers. thats when i suspect it "came open". i mean its logical reasoning. mail guy is seen dropping off the bin of mail. (he's a rural mail guy, drives his own minivan etc). then when they handcuffed me and questioned me they state, "your landlord said you've gotten more packages recently". can SHE hand them over, personally i dont think so since she isnt a postal worker.

if i get a reply within the next 30 mins, i can go ASK HER, since she works for another hour today.

ask her what, if she opened your mail? go ask her anyway...

i meant i was going to ask her if she gave my mail to the cops, not if she had opened it.
i'd have to wait til tomorow tho because she's already left.

i'm sure she gave it to the cops bcause they stated that my landlord had informed them that i had gotten packages in the last few days/weeks. can she turn over my mail to police? whether its opened or unopened?

also i had other syringes of spores (legal infact) on their way to me, now it seems all these packages have disappeared and havent arrived, when they should have been here days ago.

do police need a warrant to continue to get my mail? and if so, dont they have to present the warrant to me to continue getting my mail?

Perhaps the police have popped in on the folks that are sending you these items so they can violate their constitutional rights as well......

Or, they went to them first, then started contacting everyone on their customer list and you were one of said customers?

if the police have been "popping" in on others that sold or traded to me, then i'd consider that harrassment based on the fact that the selling/trading of the spores is legal because the spores themselves contain no controlled substance(s).

yes, i have grown LEGAL stuff before, i've grown many mushrooms from Ganoderma lucindum (Reishi anti-cancer mushroom) to Panellus stipticus (Glowcap, they actually glow in the dark and are HIGHLY poisonous if eaten yet legal). i've also grown the ever popular portabello and enokitake mushrooms. i'm guessing my case must not be too high priority because i havent heard a single thing from the police yet. havent even gotten a court date yet. maybe because of the holidays, but i doubt i'll hear back from them, they're probably waiting until i screw up even worse or something. i've seen methlabs here get thrown out of court because of slightly sloppy police work, and my case was EXTREMELY sloppy considering it took them 2 1/2 days after recieving my mail to even come to my door, then entering without a warrant and THEN! arresting me in the hallway. even after that they searched my house and questioned me without reading me my rights or asking consent , all they had to do was keep me cuffed until another cop from the station got a warrant and brought it here. the lead guy even told me he wasnt sure if the prosecutor would even push this matter, he seemed disappointed when he said that also.

funniest thing in the whole ordeal was this statement.

"you arent under arrest okay?" (then read me my Miranda rights).
he should have done that when they were cuffing me, and if i wasnt under arrest like he said later then there was no need to read me my rights!!!!
he waited until he found incriminating evidence to read me my rights, which wont hold up in court at all, because i should have had the option of my Miranda rights before they RE-entered my house.

The USSC has ruled that even if you are only detained, if the level of force used for the detention is equivalent to that used for an arrest (i.e. put in handcuffs) then Miranda would apply. And even then, they do NOT have to be read until you are both in custody and being interrogated. Just slapping the cuffs on you would not be sufficient to involke Miranda. However, once you were cuffed, any questions that might lead to incriminating statements or evidence could potentially be suppressed if Miranda had not been read to you.
