Visitation has been suspended pending a DHS investigation.

I spoke with the judge "in camera" (course I had NO idea what that meant... I was looking for a camera, thinking like webcam). I spoke with him for 35 minutes. After all was said and done, he said "off the record, I can't wait for this man to be in my courtroom". The judge said I should not have any contact whatsoever with Dad or his family. No problem there.
I presented every piece of info I had to him, I truly believe the "sinker" was the daily pictures I took of Son. I had a few from a day before he went into the hospital and took a picture of him every single morning in the hospital. Vent and all. Admittedly, there are difficult pics to look at. You can see son decline and then begin to heal. They got the Judge. Thank you everyone for all the help. There is a hearing on Dec 4th to give Dad a chance to contest.

Got 2 texts from him this evening.

First: wat time do I get him thurs?

33mins later: listen, jst cuz my wife beet ur (f word) (a word) dnt mean u get 2 ignor me.

Can't even roll my eyes enough to cover to the feeling.

stupid piece of scum.

DO NOT respond to that lump of cow manure!!

WAY TO GO MOM!!! wohoooo!! i am SO sorry you had to go through all that in order for justice to be served, but so glad of the overall outcome.

He is seriously one of the stupidest people alive. He acts like he is 15. Actually, I take that back, my 15 year old daughter's text-ese is more coherent than that, and she's never been near a fight, let alone condone someone beating down a pregnant woman.

I've been following your story. Make sure you follow through with everything, and the grave dad has dug should stay a gaping hole. Make sure you take care of yourself and your yet to be born baby...I think you need a spa day...

Time to send him your lawyer's phone number again. And, "anything further you have to say to me, must go through my lawyer".

You will come out on top of this whole thing as long as you remain composed, logical and with your child's best interest ahead of all else.

I know I am no one to you, but I do have to say that I am proud of you.
 
Curiousity question:

Were holidays ever address in your court parenting plan?

Yes. However the way his atty worded the order, he is not given any holiday time until kiddo reaches two years old. It says (not word for word) "when the child reaches two years of age, father shall have standard visitation. Which includes 2 summer weeks and alternating holidays"

To be honest, Dad and I have been splitting holidays. We each take a little time with the Kiddo.
 
Time to send him your lawyer's phone number again. And, "anything further you have to say to me, must go through my lawyer".

I guess I no longer have an attorney. She communicated with me a few times when I was having problems at the hospital. She no longer returns calls and emails. I found out at the courthouse today that she withdrew from the case in late July. I'm on my own for a while until I can afford a retainer for a new attorney.

this is a good time as any for dad to start paying YOUR legal fees.
 
That court order is not going to survive until kiddos 2nd birthday.

You're probably right. Now, anyway.

Up until the hospital, Dad and I had been getting along pretty well. I agreed to give him some extra visits here and there when he asked. We were able to switch Saturdays once because of my own family reunion. It was genuinely working. And then the hospital came about and well, it all went to crap.

It was going to go all to crap anyway. The whole hospital thing was just the catalyst. No way those crazies could have held it together much longer - and I think you know that.

Head straight down to the police station tomorrow and report that text from Dad. Do NOT respond, not with an attorney's number, nothing. YOU do not want that RO being overturned because you communicated with him.

Have any of them been served?
