However you want to call it, you didn't get the job. They are not interested in hiring you. No law is going to require them to hire you; no law has been violated.

They can call it not eligible for hire; they can call it not eligible for rehire; they can call it a toaster; they can call it Gary. NONE OF THAT MATTERS. They do not want to hire you now - it doesn't matter one whit whether you were ever hired before.

It is their right to refuse to hire you. It is not your right to be hired.

So i see you're not answeing any questions. Leads me to believe you do not know what your talking about. Do you study law? Do you study case law? Nope. Thats for your input.

But let me see if I can help make it clearer.

It doesn't matter that the employer has you marked "not eligible for rehire", "not eligible for hire" or "And annoying butthead that we don't want to hire." They have made the completely legal decision as an employer NOT TO HIRE YOU NOW OR IN THE FUTURE. They did this because they believe, rightly or wrongly, that you lied to them on a previous application. Further it doesn't matter if it is rightly or wrongly because it isn't because you are in a protected class, hence it is legal.

And MOST HR professionals are not lawyers. But many of us do read and study more about employment law, including case law, than the average lawyer.

That is for the individual employer to say. The law does not take a position either way.

But, for the last time, IT DOES NOT MATTER IF YOU WERE DEEMED AN EMPLOYEE OR NOT. They are free to refuse to hire you and the law does not give half a hoot whether they call it a hire or a rehire.

Huh? Did you read either of the replies? We don't know because it's not a legal question. As to whether or not they broke any laws...based on what you've told us, NO, they didn't break any laws.

Seriously, why keep this going? Your questions were answered from a LEGAL aspect. If you do not like or believe what you're being told here, log off and go pay an attorney to get your answers for you. I can never understand why people stay here and argue after being told the LEGAL answers to their questions. Channel the energy into finding an attorney since you don't like the answers you're getting here.

Never said it was illegal to not hire. Me i know that dont have to that doesnt mean they didnt discriminate against or use unfair hiring practices against. So yes i know i dont to hire me.
