What is IMO?
He does return calls it just takes him forever to do it. He seems confident that we can win the name change and visitation if I like. He says that her attorney is just going to keep throwing things at us so I will give up. I have a feeling from doing research on this site and on my own that even if they bring up the DUI's I'll still be able to keep his name as it is and get visitation. I'm his father, and no matter I'm awared certain rights whether she likes it or not. (this is how my lawyer put it to me)

No one can really say what the judge will decide. We don't know the entire facts of your case (you lied to the court, what makes us think you are being totally honest with us?) The bottom line is if a judge will think you are acting on the child's best interest when you want to deny the child having the same name as his 'father'. You are the biological father, but you've not had contact with him in 9 years...so do you think a court will think you know what is best for him?
You are the ones I'm totally honest with. And I didn't think that I was really lying on the discoveries.
My son had an interview with the judge last week. Will my lawyer be able to find out what he said?
My lawyer has said that a lot of times kids will say that they want to meet their parent. So that could help too.

I doubt that the supervised visitation would last that long, or that they would make me take a parenting class. I live with my girlfriends kids who are around the same age as my son. They are fine.
Drug testing? Alcohol only takes 2 days to get out of a persons system. I'm not a drunk, I can go 2 days...easy.
Does anyone know if my lawyer will get a copy of what my son said at court? I have a call into him, but just curious if anyone knows.

Probably not- At age 9, the judge probably wanted to see how your son felt about the name change. ie; if he also wants to have the same last name as everyone else in his 'family'. Afterall, he's not losing YOUR name...he never had YOUR name to begin with. The judge will likely wonder why you even care, since it's not your name he's changing anyway.
Re; alcohol- You can "go 2 days easy"? Whooppeee, problem is you can't go WITHOUT- hence your FIVE DUIs.

Anyway...My lawyer did do a backround check on her. There was no DUI's. The only public record they found on her was a judgment that was paid, and one that was not.
Do you think, (though it might not be a big deal to you) that the judge asked him some of these questions (smoking, drinking?) I could be able to use that.

Doesn't matter - drinking and smoking are not illegal activities. Driving while intoxicated IS. Mom is allowed to have a social life, and she seems to have done a decent job of raising her son without any help from you. That will impress a judge more than any stupid pet tricks you can think up.
