What is the name of your state (only U.S. law)? NY
So I am selling a motorcycle for 5k, The dude wants to buy it, He says he can give me a bank cashier's check for the bike, I agree because a cashier check supposedly more safe then personal check.
I put it in my bank, I sign the title, I give a basic receipt (X purchased blank for 5k cashers check) and sent him on his way, and threw away his info when the check cleared. thinking all is well...
After reading a post, I realized... What if the check was fake? what if my bank clears it, I buy a new car, and it comes back fake? WHAT IF THE CHECK IS FAKE!!!
So, since I have no idea how to find the dude I sold the bike to, and the bank held the check for 24 hours (business) before clearing it, and only after 3 weeks found out it was fake, can I defend that they should not have cleared it if it was fake? and being the bank, they should have caught that while I still could have done something?
Is there any defense, or am I stuck owing the bank 5k. I am now nervous.
