So I am selling a motorcycle for 5k, The dude wants to buy it, He says he can give me a bank cashier's check for the bike, I agree because a cashier check supposedly more safe then personal check.

I put it in my bank, I sign the title, I give a basic receipt (X purchased blank for 5k cashers check) and sent him on his way, and threw away his info when the check cleared. thinking all is well...

After reading a post, I realized... What if the check was fake? what if my bank clears it, I buy a new car, and it comes back fake? WHAT IF THE CHECK IS FAKE!!!

So, since I have no idea how to find the dude I sold the bike to, and the bank held the check for 24 hours (business) before clearing it, and only after 3 weeks found out it was fake, can I defend that they should not have cleared it if it was fake? and being the bank, they should have caught that while I still could have done something?

Is there any defense, or am I stuck owing the bank 5k. I am now nervous.

There was nothing obviously fake about the check, and when I brought it to the bank of its origin, it said I couldnt cash it there because i didnt have an account there,,, not that the check appeared fake.and the guy didnt seem criminal or anything...

I think it is unreasonable to think I should keep the title and bike, and money 3 weeks to confirm it's all valid.

Am i right to worry?

Cash is king.

If the check bounces, run the vin to get the guys contact information and file the report with the police. It is amazing how guys in bad uniforms and guns motivate people.

This is a very common scam.

If the check is fake, you will be liable to the bank. The man who gave you the check will be liable to you.

Sorry, Thanks guys, the bank said, the victim (me) is supreme victim, and if the check comes out fake, then I owe the bank, and I have to get the bike back, and they close my account due to fraud. and that will be on my banking history :(



lol, I hope the check is real... !!!

The bank may not tell you anything. You are just going to have to sweat this one out.

Well I did only get the tellers oppinion, he said (at least) criminal charges wont be brought against me, but i could be sued for the 5 grand... I dont want to take anything he said too far, he is just the teller.


(ps, i wish you didnt quote that it appeared rude, I was just thinking in post... lol)

Do you think I could tell him I want cash at this point? (if I could just give the check back to seller) I should have known...

I signed up for the FDIC's special alerts and I get information such as cashier check fraud (bank name and how to check) as well as all the banks that are closed or taken over. I must say my email notifications are screaming some Friday afternoons.

Did you make a copy of the check before you deposted it????

When we sold our Harleys we only accepted cash or wire transfers (buyer's bank to our bank). We checked the cash to make sure it wasn't fake. Paranoid? Yes. Prudent? Yes.

Wireless should also have the alerts - PM her with the information and she can check the bank to see if there are any fraudulent checks. Right, W?

Well what I could do, as far as the bank is comcerned, is I could, maybe, keep the money in the bank a month to immedeately pay the bank if it comes out fake???

Oh man.. Oh well, I will mitigate the possible damage by keeping the money in the bank, if they do clear it, until it is all solidly clear. Then I might try to argue them out of closing the account due to fraud, by having their money available.

lmao, I learned something today :)
