That site has a search function which returns two results for the inquiry "Chase". The notices are from June, 2006 and July, 2007.

Counterfeit cashier's checks bearing the name Fox Chase Federal Savings Bank are reportedly in circulation

FDIC: SA-174-2006: Counterfeit Cashier's Checks Bearing the Name Fox Chase Federal Savings Bank are Reportedly in Circulation
FDIC: SA-177-2007: Counterfeit Cashier's Checks Bearing the Name Chevy Chase Bank, Bethesda, Maryland, are Reportedly in Circulation.


Are they both for the same "fox chase?"
Because it was just CHASE. I think it is a national bank isnt it? well I didnt see it either...

Because we couldnt find any should I fell alittle more comfortable?


I just wish there was something I could do to get the check back, and demand cash. oh well, its going to be a long month. lol :)

Here is the section of the UCC that deals with late returns.

§ 4-214. RIGHT OF CHARGE-BACK OR REFUND; LIABILITY OF COLLECTING BANK; RETURN OF ITEM.
(a) If a collecting bank has made provisional settlement with its customer for an item and fails by reason of dishonor, suspension of payments by a bank, or otherwise to receive settlement for the item which is or becomes final, the bank may revoke the settlement given by it, charge back the amount of any credit given for the item to its customer's account, or obtain refund from its customer, whether or not it is able to return the item, if by its midnight deadline or within a longer reasonable time after it learns the facts it returns the item or sends notification of the facts. If the return or notice is delayed beyond the bank's midnight deadline or a longer reasonable time after it learns the facts, the bank may revoke the settlement, charge back the credit, or obtain refund from its customer, but it is liable for any loss resulting from the delay. These rights to revoke, charge back, and obtain refund terminate if and when a settlement for the item received by the bank is or becomes final .

Basically Banned, this is what can happen. If the cashier's check is fraudulent the bank returning the item will use "within a longer reasonable time after it learns the facts..." to initiate a late return.

I really hate to be the bearer of bad news, but it can be months after you think the item has paid. Now, I'm not saying that will happen, but in the even that it does, you will want your bank to file a breach of warranty claim against the bank that is initiating the late return.

I hope things go well for you Banned, I wish you would have come to us before you took the check. My recommendation is for you to hold it as long as the UCF hold is on the account.

Next time...Cash is King. I know, I know...beat a dead horse:)

OK... that wasn't stellar news. It was all I could come up with on short notice.

Just read the whole thread. Couple of things

1 ~ I don't think your bank will brand you a thief is this turns out to be fraud, but they will look to you to pay the money back. Now if you were a new customer and you used this check to open the account, that would be a different story.

2 ~ I'm a little weary about wire transfers. Country is right, once the money is in there, they cannot take it back out without your permission. The problem with that is that you may be giving a perfect stranger your account number. Once they have that number they can continue to use that number to pay their bills (I've seent that happen many times). A recurring theme for dealing with people you don't know ~ CASH IS KING.

3 ~ Some banks (mines does) now let you wire funds through online banking. There are limitations so check with your bank.

4 ~ It doesn't make sense to put a lien on the bike after he has paid for it. In fact if you gave him the title, you can't.

I think we covered it all ~ lesson for all of us. At the end of the day we all need to be very vigilant when it comes to our money. I always tell my clients, that as a banker I keep their money. THEY are responsible for knowing where and to whom it goes. It is THEIR job to tell me if something is wrong and there is a very reasonable time frame for telling me. YOU are your own best defense.

I only let the sending bank have my transit routing information. Before I give it to them I ask about their security measures (do they need to keep a paper copy, if so - where and how is it secured, etc.) I watch them shred the document if they don't keep a paper copy. No, it's not paranoia - it's reality.

In case some of you are not aware of this - there are some weird people out there!

Hey Banned, I was driving home and remebered that you are in New York. NY did not ratify changes to the UCC as did the most other ststes some years ago. I don't know if this section of the code was affected. You can check that out.

If something happens, let's hope not, but if it does the breach of warranty claim would be bank to bank. You would need to insist that your bank take that initiative. We could cross that bridge if we get there.

That guy was a dork, huh Country. I am glad M gave him the boot :)

Thanks you guys, for the great advice... you will be happy to know, I was in fact worried over nothing and I was paid by my bank no problem, and when I called the bank to make sure, they were able to give me the numbers on the check (routing number or whatever) and I was able to get someone at chase to satisfy my interest by verifying the check to be real *whew*

I certainly did learn a lesson with this, and I will (if ever again) insist on cash... or at least be more diligent in my effort to protect myself from fraud, or being swindled in any other way.

dodged a bullet ... thanks you guys.. really. :)

In case anyone searches this thread in the future, just for completeness' sake, in NY it's codified in 4-212 (instead of 4-214).

Fake checks are always a major problem, even fake money orders, certified checks, etc. Counterfeiters are good these days. Even fake travelers checks are floating around.

Do you still have the buyers cellphone number or home number. They must have called you. If you have a cellular, look on your phone bill and find the number as they are generally all logged. This would help.

The police dept should be able to do a VIN search while you are processing a report with them for the bad check.
