reporting false information to dss

What is the name of your state? Massachusetts. I am currently having a lot of trouble with my ex and his current gf. I found out 2 days ago that my daughter was brought to the ER almost a month ago, by them with alligations of sexual abuse towards my fiancee. Dss was called in and was there while she was given an exam. She is 2, the papers were filed by his gf, not himself I know because she spelled both our names wrong. The wrong address for him was given, he hasnt lived there in atleast 5 months. Dss found no evidence that supported the alligations, and decided it warented no further investigation. The ER gave them instructions to treat her "rash due to poor hygine" and sent them home. She had been at their house 2 days, and had blisters on her bottom. They are reporting me and my fiancee to be vindictive, I am not afraid of dss because I know I we have nothing to hide, but is there something I can do about more false information being said about us? Can I file a slander or deffermation of charcter suite? Ohh the real kicker, they sent the ER bills to me... I called and had them redirected to his home. Is there any leagal thing I can do as far as my daughters safety and our reputations are concerned?

You're going to have a hard time proving that they were false allegations. Two days of less than perfect hygiene is unlikely to result in blisters on a little one's bum. Redness? Sure. Blisters? There was likely something already starting before she got to Dad's. Unless Dad & g/f are calling DSS every time you turn around. this would fall under being cautious rather than vindictive.

It depends on the child and if the child is still in diapers. My daughter could go from no diaper rash to blisters in less than 24 hours in the summer time. I couldn't let her sit with a wet diaper for any length of time at all.

We're talking Massachusetts in March. Not summer anywhere. Except, well, the Southern Hemishphere.

OP found out 2 days ago. That would have been April 21. With me here? A month ago would have been.... TA DA!!!! March 21. ALMOST a month ago, would most likely have ALSO been March! And even if it was, oh, say, THREE weeks ago - we're STILL talking APRIL in MA! WHICH SURE AS EFFIN' HELL AIN'T SUMMER! You're not REALLY this stupid, are you?

With my oldest, it didn't even have to be summer time. She was born in December. I changed her diapers as soon as they even thought about being wet, and she STILL had lil blisters on her booty every day or so.

But, mom is probably still fighting a losing battle trying to prove that father was being vindictive.

Just as a head up on the GF taking the kid to the doctor. My daughter had a female problem and I PREFERED that my wife take her instead of me. She knows more about what a doctor would know about and my daughter felt a lot more comfortable with another girl there instead of a man. I realize the girl is only 2 but at least they realized there was a problem and took actions to have her treated. Honestly if my daughter had blisters down there the first thing that I might have though was some type of STD if I thought she might be being abused. They might have been trying to make her as comfortable as possible in an uncomfortable situation.

Im not sure which branch of the government would handle that. :p

your ex was being a good parent and took the kid in for an exam, whatever was seen and/or said was enough for the doctor to call in CPS.

no harm no foul. if no charges were filed against you, and no investigation was even begun, you don't have anything.

I dont think what I said was said properly, had he brought her to the er because of her rash I would have understood completely. But, he brought her to the er to accuse my fiancee of molestation. The Dss investigator found no evidence of this, and the doc found that what they were claiming was because of abuse was because of their own neglect. She often comes home from their house with diaper rash, never this bad. The er doc gave them perscription cream that they never sent home because they didnt even tell me about the visit untill she (his g/f) told me on wednesday night. I wouldnt put it past the 2 of them to have left her in a diaper so long she got a rash, and for one of the family members to say it looks like an std and to take her to the er, there was another member of the family with them. They want to accuse and threaten not to pay support, but my child comes home from their house in dirty clothes, with dirt under her fingernails, hairspray in a 2 year olds hair, and scratches on her (from his gf's son) and sever diaper rash. But he is accusing me. Also, CPS was not called in by the dr, it was called in because on the information given upon arrival to the er, they stated that they were suspicious of sexual abuse. As a result a Dss worker was sent in to observe the exam and nothing was found.
