My brother who liked to use perception Drugs was doctor hopping for a back injury well his doctor worte him a perception for dalild fours no idea on spelling its a pain killer this is a pain management doctor zanex he wrote this for a months sluppy well my brother took all of them but 5 in 10days so he calls and says these are giving me seziours to get a more meds so the doctor says come and bring the old script with you so my brother purpsoely forgot them so he could get more drugs so the doctor wrote him a new script for pain patchs and says here you go well that night he oded on his patches mixed with old meds and dies so the doctor calls 2 days later and tells me he my brother had an apment and he needs to bring back the old drugs becuase if not he will get in trouble for wrighting the 2nd script so i say umm sir joe oded and i dont think your gonna see ur meds he was like "wow i dident give him any thing he hasent experimented with befor" knowing my brother was a pill head can i sue this jerk? for negligance? cuz if he would of followed procduer my brother would not be dead!

So your brother was doctor hopping to get more meds and now that he is dead from taking an old and a new prescription you want to sue for negligence? I don't think that will happen. No, disrespect to you or your brother, may he rest in peace, however, it appears to be your own brother's negligence for not doing as the doctor instructed. You can't expect to get paid from the doctor because your brother had an obvious drug problem.

Maybe they should file a suit in federal court pro se after attorney's tell them they have no suit. I know a troll who would love to help them.

Your brother was the one abusing the drugs, if this doc hadn't provided them, he would have just went to another doc, or an emergency room, or bought them on the street. Addicts who want to find their fix always have ways of finding it.

This doc did nothing wrong and you cannot sue him for prescribing meds to try to help someone who then abused them. He was no overprescribing, or deliberately prescribing too much of something or prescribing stuff he shouldn't.

I know losing your brother is painful, but no one hurt him or caused his death by himself.

You would also have no recourse unless you were the legal guardian of your brother, only your parents, if he was a minor or a spouse if he was married.

You cannot even spell most of the words you are using, it is Prescription, Dilaudid, Xanax, purposely, appointment, writing, od'd, didn't, hasn't, before, negligence, and procedure.

The doc did nothing wrong, he used to knowledge of what your brother tried before to make sure that he didn't have bad reactions or allergic reactions to certain meds.

He would also not get in trouble for providing the new prescription, the whole reason he was really asking for them back was to try to prevent your brother from using them both at once.

Sorry, the only one at fault here was your brother. He obviously had a drug problem. Not all docs he hops to are going to know that or know how to deal with it.

See that is what I mean,that was just four days ago that,that was posted!This is why we have all the medical malpractice changes.This is why people who are seriously hurt by malpractice don't stand a chance.People are being diagnosed with cancer when they don't even have it and dying from chemo that they didn't even need.People are being diagnosed with something other then cancer and are dying because of late diagnoses.People are dying and are seriously hurt from a serious medical error.It's sad that your brother died like he did,didn't anyone in your family see that he had a drug problem?If that were my brother I would have done what ever it took to git him some help.How was the doctor to know that your brother was going to take more then he should?It sounds to me that you are looking for something to sue someone for,I mean come on! Two different posts to see if you have a claim for two totaly different reasons.That is sad!

Lol my lawyer just filed the lawsuit and they have offerd a 3.5 mill settlement just an fyi thanks the admits he was in the rong also

I would really like to know what state you live in,because that sounds a little too steep for them to settle out of court for that amount.I thought alot of states now have caps on how much you can sue for in medical malpractice caseI'm from Missouri the Show Me state I would have to see the proof.that also seems alittle to fast for a settlement since it wasn't too long ago that you posted. I have a feeling your trying to snowball us....lol

Correct me if I'm wrong but I think I just read where in 2003 the medical malpractice law stll stands:For most medical mal cases pain and suffering caps are $500.00 and in some catastrophic cases 1 million.So if this is right why would they want to settle out of court for alot lot more then that?
