summer issues

I am the CP of a nine year old and live in Illinois. Ex lives in Texas and Texas has jurisdiction.

My ex gets 6 weeks of summer visitation. I get 21 days which I designate after he has chosen his dates. This year he has chosen a six weeks period that makes it impossible for me to have 21 days. I've told him that he needs to adjust his dates to allow for the 21 days I am granted. He refuses and says I must work around his dates. Whose right?

How is it that he's chosen 6 weeks that don't allow you 3? Or is it the way the school schedule's set? It would help to know exactly how your order is written. But I suspect you're the one who has to eat the time - you, presumably, have the kid the most of the rest of the time, right?

Well, it would be possible for him to choose 6 weeks that would allow me to take 3, he just hasn't done so. School gets out on 6/10 and begins 9/4. He wants her from July 11th to Augest 21st. Since Father's Day falls on 6/19 and he gets that weekend, there is no free three week period before then. The problem thus is with his choice of dates. Is it not then reasonable to expect some adjustment?

I just looked at a calendar...and June 20th (the monday after father's day) to monday, July 11 is exactly three weeks. Therefore it doesn't appear to me that anything needs to be adjusted.

(edit) Except July 11 is Sunday, so that's a day short. That level of nitpickiness is unlikely to impress a judge.

You need to grow up and get over it. Even though I agree this poster is in the wrong, you are offering no legal advice at all and can't distiguish between your own personal problems and others. You are not a benefit to anyone here.

I have to agree. Get off your own agenda. Not every bioMom is like your husband's. Not every Dad is your husband. Try taking the blinders off.

Here's a mom who has the child the majority of the time and is complaining that dad's six weeks during the summer may mean she gets a day or two less than three weeks. Yet during the school year she's going to be having the child far more often than dad. It's not going to hurt her OR daughter to let dad have his whole six weeks.

Look, if she's going to cry over a couple days, go to court, waste the court's time. The order says HE gets first pick for his time. Does the order say he HAS to pick Father's Day as one of his days? To my knowledge, holidays override who would ordinarily have the child. Just eat the couple of days.

Actually, I'd like you to go to court and tell us what the judge has to say on this.
