Tenant repair rights in a month to month agreement

i'm a tenant in california who is having problems in getting repairs done in a single dwelling, month to month agreement with the landlord. The hardwood floor in the home needs repair. My family has gotten numerous splinters in their feet. the roof leaks in several places during the rainy season. (the landlord got an estimate of $10,000 to repair the roof recently). We attempted to hold back the rent to put carpet on the floor, but we got served a 3 day notice to pay rent or quit when we did it. Is it true that there's really nothing we can do because of the month to month agreement?

:mad: HI,, it seems like landlords can do what ever they want, we want to consumer affairs and told them of the problems with the house and than the landlord takes us to court, we paid alot of money to live like animals,, this is horrible

When a renter is just a month to month tenant even if you were able to get the LL to make repairs your LL still can either just raise the rent or give you notice to vacate , its that simple . Your best bet find another place to live that is in better shape and vote with your feet and give your notice , when you do make sure to take pics of the water stains from leaks and other general pics of the place .

**A: both m/m and long term lease tenants have the exact same repair and deduct rights. The problem that you have is that you did not follow the correct procedure pursuant to CA Civil Code by sending L written notice to repair etc.
Depending on the communication with L on this subject, you would have been able to file a retaliation counterclaim but only if your rent was paid current.
