What is ARD?

What is the name of your state? NJ
What does ARD stand for? From what I see here it appears to be a type of alternate sentence for DUI? How does one qualify for it?

Thanks for the reply. I did not get the DUI, it was my BF and it was an out-of-state (w/NJ license). I just don't remember ARD coming up at all. He had a DUI over 25 years ago, so I don't think they held it against him. So far, he has not had any penalties in NJ yet but I'm sure they'll catch up sooner or later. If so, will he be eligible for ARD in NJ?

He have to find out if ARD is offered in the state he got the DUI. He should also find a lawyer.

He's already gone through all that -- hired a lawyer in the other state (AZ), went to court, got his sentence, did his time, went to the class, etc. Now he is just waiting for the other shoe to drop here in NJ. The AZ lawyer could/would not tell him anything about what will happen on this end, and he has put off hiring a lawyer in NJ until he actually hears from NJ State or DMV. I was just curious about ARD, I see it mentioned a lot but have never heard of it. I don't think it was offered to him in AZ; his lawyer told him he was getting the minimum since he had a clean record and his BAC was only .12. He also still does not know if he'll be required to install an alcohol detection device on his cars. I've lived in NJ forever and never seen anyone have one yet.

ARD is a Pennsylvania thing for probation in lieu of a criminal conviction.
He's already been convicted, NJ can't convict him further.

What may happen is that the NJ DMV will suspend his license and/or levy surcharges. I've long ago given up trying to unravel the corrupt system up there.

Hi Ron, I see you mention that NJ can't convict him further, but switch states (NJ DWI w/PA license) doesn't the compact come into play?

Long story short I had a DUI in PA 8 years ago, got ARD. Got a DWI in NJ last weekend. Basically more ashamed then I've ever been and only thankful that I was pulled over and had the keys out of my hands.

I've rec'd a good amount of advice from people, but was curious since this person's DUI is in the out-of-state situation with AZ & NJ.

When you got ARD, you agreed to a 7 yr look back for priors. DUIs getting ARD today face a 10 yr look back. So PA might view this as a 1st offense, with no further ARD available. I live in NJ and what this over regulated, corrupt, special interests pandering sorry state will do I have no idea. The Politically Correct thing to do in NJ is crucify all DUIs. I'd hire a lawyer with a lot of experience in NJ AND PA. I can certainly identify with the remorse you're feeling.

The compact exists between PA and NJ. I'm not sure what you're asking. As far as NJ is concerned, PA didn't happen if you successfully completed ARD.

yes, lawyer said that PA will look 10 years back, but that it will be a suspension. I can't do jail time in two states. PA can't hold jurisdiction over NJ, but they can suspend.

I guess what my confusion is whether the sanctions that PA has for an offense with one prior apply to my case? I would think they didn't because it would be PA over-ruling NJ's jurisdiction. Well, that's what the lawyer said.
