My minor daughter is pregnant by a adult male. He has admitted to being the father, We would like to start recieving child support while my daughter is pregnant in order to take care of the necessities crib, clothes for the mother and child. Is recieving pre-birth child support possible? or do we have to wait until after birth.What is the name of your state?

Child support begins when there is an actual child, paternity has been established and the court makes an order for him to support the child. Until then, if she wants a crib and baby clothes, she may want to start buying those herself.

I would be EXTREMELY surprised if CS was ordered and received before the child is 6 months old by the time the wheels of CSE grind into gear, paternity is established (count on a DNA test and that takes time) and Dad has the opportunity to dispute the amount...

In my case, my son was born in January, I filed for support in February, got an order in June and finally got it finalized in November so that payments started in December.

In CA, you can apply for support while pregnant, but all they do is hold the paperwork and order until you give birth with a reserved order and that is only if he doesn't change his tune between now and then and then hold out on a paternity test (if he doesn't sign the AOP). But nevertheless, no, I wouldn't go looking for a dime for at least 6 months (and that's if he's cooperative).

a friend whose girlfriend left (with the child) had a DNA test AND a court order within 2 months after she left and that was with some waffling and discussion between the 2 parties.
If she headed straight for the courts, it would have been less than a month.

Piggybacking on JALM, I will say that this will all go a lot faster if the OP's daughter wants to hire an attorney and go to family court, as opposed to having Child Support Enforcement deal with it.

Well, I left out a lot... I applied for CSE services and they set an amount. He responded w/a dispute over paternity (even though he'd signed the AOP) and they refused. So he got to have a hearing on whether they'd do a DNA test. He was turned down. So a final hearing re: the amount was set for November.

In the meantime, he filed for parenting time, child support and paternity establishment in the court of the county he lived in. So I did the DNA thing, and the results came back just before the hearing in November. I sent a settlement offer to his attorney that included a child support calculation of more than 2X the disputed amount that CSE had set.

He dismissed his parenting time petition, and didn't show for the CSE hearing.

Nope. Dad has no liability for mom's maternity clothes - he'll probably also need to set up a nursery at his house as well. So EACH parent will need to supply their own nurseries for the period of time when each of them have their child.. Until there is a LIVE birth AND a paternity establishment, there is no legal father.

Remember, BOTH parents will be responsible to support the child they both chose to make. So mom will also share financial responsibility. If the finances are THAT problematic even during the pregnancy, maybe mom should rethink the wisdom of choosing to parent a child at this point in her life and explore alternative options.

Craig's list, EBay, resale shops. yard sales, etc. are alternative resources for baby supplies. I'm not at all ashamed to have had a USED crib and changing table, a used toddler bed, and used toddler clothes for a good portion of my child's wardrobe. Matter of fact, we had no clue what size she'd be when she came home, so we bought a selection of sizes at yard sales. Target. btw, always has deep discounts of their Liz Lange maternity clothes. Yesterday, I saw a mess of them at 75% off.

I just gave away a nice working fridge on freecycle. I love freecycle for garden stuff, too.

I got a toddler bed for Twain and a nearly new futon mattress w/cover for Wild when I redid her room. And I've given away a TON of baby stuff over the past year.

Hey Nexie... you got all high falooting. You had a changing table???? Shoot, we just used the bed, the sofa, whatever was flat and diapers could be changed on...LOL:D

As we do this with step parents, I would like to take this time to correct some things in the OP's original post:

Unless you also had a child or are having a child by this man, WE cannot ever collect child support.

Also, as for the second bolded statement, this man is under no obligation whatsoever to ever provide anything for your daughter, as she is not his wife, she is simply the mother of his child and that creates no legal obligation. So if your daughter requires clothing, she needs a job, or perhaps her parents would be nice enough to provide that for her.

Actually, we had one that my brother was gonna give away. I didn't say we USED the darn thing!!!!! We also gave it away.

Kiddo was too BIG to be lifting up onto a changing table all the time, and way too squirmy! We simply would lay a clean towel out on the floor and change her on that.

It's funny that if such an item is passed down through a family, it is an heirloom and as such deserves great respect. If a person purchases from outside the family, the items are looked at with disdain.

Reminds me of a story about an aquaintaince.

He often sold furniture tagged as a "family heirloom". Most folks figured they were from his family. When another friend saw the other guy out and about one day, he asked what he was doing. The first guy responds "buying family heirlooms".:eek: They were thought of as family heirlooms, just not from his family.

It's all a matter of semantics.
