Well when i talked to our (car#2) insurance co. she stated that we are not coverd seeing we only had minimum insurance,i guess its called liability.
She stated that if Car#2 is proven to be at fault then we would be held responsible for car #1,which i agree with,if we are at fault.

Someone told me that they have to pay some of our medicals but why did she (the insurance claims adviser)tell me they didnt,just cause shes trying to save money??

I know i should read the policy but with my education level i dont think i would understand any of it. Again thanks all.

Since you only purchased liability, you only purchased coverage, that, in the even that you are at fault in an accident, the OTHER PEOPLE in the other vehicle's medical bills will be paid up to the liability limits that you bought. If you had purchased a coverage called medical payments, it would have paid for some of your medical bills (usually people purchase about 5k to 10k), regardless of fault. It pays PER INJURED PERSON. So, each person in your car could have had up to 5k or 10k worth of bills paid.

IF the other party was determined to be at fault (and I don't see why they would be), then they would be responsible for your medical bills, and the damage to your car.

Good morning Moburkes

Thanks i did only have liability,and i will agree to pay the other vehicles medical bills but my insirance company denied them all damages. I guess there is no real proof that car#2 is at fault with everyones statements. I am still waiting to pay the other vehicles bills,i know it sounds to good to be true.

As for our medical bills i reallt do not believe we bought anymore than liability,so i think we are stuck with paying our own medical bills,and taking a loss on our truck. I too do not see the other vehicle at fault. I do see a no fault though.

Still i am so very grateful everyone lived more than anything.

The problem is that someone will eventually be determined at fault. You are NOT at fault for hitting the deer. But, you will, in the end, be at fault for hitting the other vehicle. If I remember correctly, after hitting the deer, you veered into their lane, and hit them. That is certainly not THEIR fault. Contact the department of insurance in your state and file a complaint against your insurance company.

FYI: Since you don't have health insurance, you should look into adding the medical onto your auto policy. It doesn't cost that much, and, after this accident, you should be able to see why it's necessary.

slowpoke, adding med pay to your policy will only help for a FUTURE accident. It will not be retroactive, and will not help pay for your current bills.

I saw that. I have been writing auto policies in NC for over 10 yrs and maybe it is just me but I can not recall ever writing a liability only policy without med pay. I just always include it because it is so cheap. I was just hoping for OP that their agent was the same.

YAY!!! Another insurance agent! I can't believe the number of people who do NOT have this coverage. I agree. Its cheap. But, so many people decline med pay and UM/UIM, and get state minimum liability. You had to get another agent if you wanted bare bones coverage, because I wouldn't write it. I had a customer yesterday ARGUE with me over the MANDATORY PIP in MI because he has leath insurance. ARGUE! Was really upset that it was required. Why? Because he had health insurance!?!?!?!?

That's silly. Even good health insurance has copays and percentages. If I'd had to pay a copay for every doctor visit I had after my car accidents, that would have been a lot of money! Fortunately I never needed surgery or hospitalization. Plus auto covered chiro and massage therapy that my health insurance either wouldn't cover at all or would have strict limits on. That guy's a moron :)

Well here it is almost 3 1/2 months later and my insurance company is still denying any money to car #1. This is driving me crazy,if I was in the wrong then why won't my insurance pay the other cars damage. I am so confused. Can whoever take me to court and sue me? I have nothing I even lost my job over this mess. Thanks again
