He gives her whatever the baby needs. When mom calls and ask him for diapers, socks, clothes, he do it. I know he's not in a good place right now, that's why I wanted to know how this would affect me. I will encourage him to do better, I'm supportive
All of this are gifts. When the time comes, he will be order to pay support going back to probably the birth. Therefore, you are better off getting a settlement in quicker than later.

ok back to you original question, which I thought I saw answered

they cannot attach YOUR wages
they cannot order you to pay cs

they can order dad to pay cs
if dad doesn't he faces losing licenses, jail, tax intercepts (joint returns) etc...

so it's very important dad get a job NOW
cause if he doesn't
the only way he stays out of trouble is if YOU pay

In that case, can the judge impute my income because he doesn't work? How much will he have to pay each month with no income?

HOw much was he earning before he quit? Do you have joint bank accounts? Joint property? If so they can both have liens placed against them for child support. And don't think of closing the joint accounts or transferring joint property -- you will be hit with fraud. You can however put YOUR paycheck into an account that is solely your own.

YOU talking to her is a BAD idea. A VERY BAD IDEA. Remember the whole thing of overstepping boundaries -- yep this is doing that. You don't have to pay anything. just be prepared that any bank accounts with his name on, any property with his name on, will be attached to pay any arrearages. That includes joint tax refunds.

Totally agree. And, about the idea that Mom just needs to be spoken to .... No, DAD needs to be spoken to. There is a baby that needs to be provided for! How insensitive would it be for ANYONE to approach a Mom that's still healing from giving birth to ask her to be lenient and pick up the slack for Dad -- who's able bodied and didn't just get done giving birth to his own child!

If it has always been that way, then yes, it means that none of the assets can be levied for child support.

However that does not mean that he can't be put through the ringer, lose his license, and maybe even go to jail for non payment of whatever a court has ordered or will order him to pay.

If you are faced with a husband in jail unless a purge amount is paid, what are you going to do? If you are faced with never being able to face married life with your husband's income/credit being able to contribute towards your family's way of life, what are you going to do? If your children can't get student loans for college because their father has defaulted on CS and has a horrible credit score what are you going to do? If you can't take a family dream vacation to Europe because your husband can't get a passport what are you going to do? If your husband's social security retirement benefits are being garnished due to unpaid child support from many years in the past what are you going to do?

The point I am making is that is simply not as simple as whether or not you have to pay for his child support. Its what will your combined FAMILY have to eventually pay if he doesn't support his other children?

If you make a good income and can support yourself, him, and any children that come along from your marriage, great,...but at a minimum you should be pushing him out the door to be earning enough to at least support his other children. That would be in the best interest of YOUR marriage.

And, a non legal opinion .... what IS he contributing to the success and progress of your family? If all these things are truly in your name, all the money and assets are yours, you are providing for your child AND the child he had with another woman, etc. ... that's a lot for you to be handling. Do you really need to be towing the line for so much? You don't have to answer me, but maybe you should want better than to have an adult child on your hands.

I know I posted an ugly post about the mother of my step-son recently. I received some harsh, yet sound advice regarding my legal stand in this fight. However, we received an email from the mother saying that she will petition the court for child support (we know the baby is his). Although I have no legal stand to this issue , will I have to pay my husband's child support if he is currently not working? We share accounts and right now I support the home, temporarly.

Are you saying being married to him will affect me, my furture children him in the long run? I married him for better or worse, I guess the worse came before the better.:(

Bolded part what acconuts do WE share.. anything in those shared account can be seized for CS
