i don't know if this applies to leases, but certain types of contracts are severable, whereby if one clause of the contract is found to be unlawful or unenforceable, then the rest of the contract is still valid.

the clause means if someone gets hurt or your prperty gets damaged while on the LL's property, you agree to not hold the LL responsible.
it DOES NOT mean that the LL does not have to maintain the property in accordance with the law.
ask the LL about moving in to another unit in the same community, or if the LL owns multiple properties, ask about vacancies at other properties. if you pick one of those other units, they may waive your application fee.
and about that deposit thing. if the lease states that each of you is independently responsible for one-third of the deposit, then the LL will not pay you the deposit back when you leave; they will pay it to the roomie that left.
