That's what I thought. Rhubarb is a liar. Probably, in fact most likely, a law clerk in some office.

You'll notice that Rhubarb's real attacks are mostly pointed at me, and that his attacks on others are really quite tangential - - almost as if he/she really doesn't want to say anything bad about other persons on this forum.

But, when it comes to me, Rhubarb hunts down my posts, even old posts, and actually makes an effort to respond when I've responded.

I have a theory: Rhubarb is someone I must have pissed off in the not-too-distant past. Of course, I do that to a lot of people!

Here's another theory. Rhubarb doesn't like people who misrepresent themselves as attorneys and constantly give false information on a public legal forum. I have time and time again pointed out false information you've given to people and you've never offered a credible defense.

Weren't you the goober who said the acceptance of a free night at a hotel meant that a person had agreed to a settlement of any possible claim?
 
Is that all you have...Big deal, If you did actually know anything then you would know that all Badge numbers are kept within the state of each Badge number. That is what the (BPSST) stands for. You call them..and of course you have my name they will tell you what you need to know...public info. And yes I am not the best typer in the world.

Why is it such a difficult thing to give me the department you work for? You after all wanted my name. There shouldn't be a problem giving me your department...unless of course you're lying.

You'll get my name Monday morning when you call with my bar number. Then you'll be able to plug it into the roll of attorneys whenever you want.

No matter what information I give you though you'll claim that it isn't enough. I've given you plenty of information to identify that I'm an attorney. You've given me nothing. Maybe that's because you have nothing to give?

You don't use statutory or case law references to back up what you say, remember? A novation is a settlement.

Do you know what "novation" means? (Ooooh, I can hear those feet go wappity, wappity, wappity, through his search engine to look up that big ol' word!)

Sorry...but I'm tired and am going to bed. It's nice playing with the juveniles but it gets old after awhile.

You have my information. I'm sure when you call and confirm you will come back on here to admit you're wrong and apologize. Yeah, that will be happening.

I do want to apologize to you though. I'm sorry for the many times I pointed out you don't know what you're talking about when it comes to certain legal questions. That has to be quite embarassing to you...being a pretend attorney and all.

Well Seniorjudge that's an interesting comment coming from someone who thinks an unrecorded deed doesn't transfer title and that an unrecorded mortgage is not a lien. Talk about Property 101. How could you possibly think that? Are you truly that uninformed about property law?

Back in the old days when I was practicing law, I won a lawsuit based on my clients' unrecorded deed and deed of trust. I guess since you have pointed out what I "think" then I should find those plaintiffs and give them back their legal fees and tell them to return the money they got from the defendants since The Rube told me I didn't believe my theories of recovery.

I am in-house counsel for a title company.

I doubt this but, if true, let's hope no one from your company reads your posts.

In order to take title in Indiana you have to be an ADULT. That means someone who is not under 18. You do understand that don't you? There isn't a person at my title company who doesn't know that a minor in Indiana can't take title to property. The abstractors know, the closers know, the people who work in the title department know, heck the people who clean the place know that. How could you truly be that uninformed?

Yep, the title police have agents in every courthouse, title company, bank, lawyer's office, bank, and real estate agency in your state, checking the IDs of every single grantee. I suppose you are also trying to tell me that the ages of the grantees is listed on every conveyance in your state. Give me ONE citation to a case in Indiana where a minor grantee received title to land and the court took it away.

I've posted my information on here several times before. I was admitted to the Indiana bar in the Fall of 1987. I am in good standing. My bar number is 13737-49. Why don't you look it up and get back to me about how I'm not an attorney? Okay, now give me your bar information. I used to think you're an attorney but given the completely inaccurate information you've posted in the real estate section, I now have strong doubts.

Check out IC 30-2-8.5 Chapter 8.5. Indiana Uniform Transfers to Minors Act. Minors cannot hold title to real estate in Indiana. It has to be placed in a trust, with an adult trustee, who holds the property on behalf of the minor until he or she becomes an adult.

Does it say in that law that a minor grantee who receives title can't have the land?

I appreciate all of this. It is the first time I have actually got to read this much conversation between attorneys or not attorneys that doesn't show up on my bill as:
Phone call to apposing counsel: $125.00 and so forth.
Back to what I belive the beginning to be from Ohio Law. I find that most people that have a problem big or small find it hard to wait for an attorney to get back to them or for the day of the appointment to arrive. The problem just eats at you. Advice from this forum rather it be right or wrong gives a person something to think about and maybe a times something to look up to hopefully ease there mind or just keep there mind busy. I find that it also give the client a few ideas to throw at his or her attorney. I have never found an attorney that new everything about every law. I have also never been billed for:
Common cents: $125.00
Although I am glad to have an attorney on my side when ever the need arises, I also remind the attorney that this is my money and I am entitled to my oppinion. If I ever find one that will not let me voice my oppinion on my dime I fire him regardless of how many framed certificates he displays on his wall.
I don't claim to be an attorney, but I do claim that what I have spent on advice to defend me through 14 dui's, 5 divorces, and one major lawsuit would probably rival any real attorney's amount of money for their education.
In all of this I spent three half days in jail. Now I would say I have a good attorney, and someone I call my friend.
What I have found that you may have the best or the worst attorney. He may give you the best or worst defense. The man you have to worry about is the judge. Thanks, and good luck to all of you right or wrong.
