And FYI after thinking about it. I really doubt I'm going to challenge the name change. Visitation I'm still thinking about

the point is your still the father

never give upon your children

no matter how hard it is ...
you can contact the family court commissioners office in your area and request mediation.. if you can't afford it you can also fill out a waiver of fees with the clerk of courts office.
if mediation doesn,t work then it will be brought back to court.
you can also file a petition or an order to show cause for contempt against her for not allowing you to see your child.
once your back in court ask for set times and days for placement with you.
since reasonable time and notice doesn't work well.

if you sit back and do nothing ..nothing will happen.. get involved
believe me i know it is not easy. never mind why the break up happened
or who is at fault.
you are this child father.. fight for you rights before you have more regrets later.

Have her held in contempt for what?? I've never seen him there is no custody order, we've never been to court on this once. I was just curious as to what might rights are, if I decide to see him.

your rights

unless you are adjucated by the courts as the father.and have proof that you are the father. you dont have very many rights unless you arelisted on the birth cetifcate
you can also contact the child support agency to start a case on your behalf
the father or a person whobelieves themselves to be the father has a right to file.. this will open a path to court ..you will be ordered to pay support but you will also be notified by the court as your right as the father. you very much need to have the court adjudicated you as the father . contact your family court commissioners office and the child support office to get this going

I dont' think you understand. Did you read my first post? My son is 9 years old. I have already paid child support for 8-1/2 years. But I've never made any attempts to see him.

I PROMISE I will not ask another question...after this one. The birth certificate was brought up, and I am not on it, nor did I have my name put on it when my son was proven to be mine. The courts (because of the name change) have a certified copy of that. Would that hinder any future custody hearings? Or (even though I don't think I'll contest) the name change? Because I never demaned my name be put on it?

By the way. You guys throughly made me feel like garbage today. Which I know I should. I think maybe someone was right, that I should talk to a professional to see if my motovations will help or harm my son.

MSDad, you should also consider speaking to a child psychologist. Though, an attorney will advise you on the legal aspect of your situation. A child psychologist can advise you on the emotional impact of it on a 9 yr old boy.

Honestly, I don't know. However, I can't imagine that it would help your case at all. A judge may question your motives for now wanting visitation after not insisting your name be recorded as the father both at the birth and after the paternity test.
