everyone else thought that the name could change even without an adoption. Would I really have to pay child support even if he was adopted? How does that make sense?????? It doesn't!

That is not correct. She could get a court to order that the child's name be changed to the name that she will be using. Not a stretch since he's currently got her maiden name, not the name of his biofather. (Note, I was nice and have yet to use the other term that fits.)

As for rights to change the child's name, your ex doesn't need your permission to legally change HER CHILD's name. It doesn't matter if you had a paternity test done or not. Until a court stipulates that you are the legal father of this child, you have absolutely no rights whatsoever.

And as far as your girlfriend and the ex's new husband, they both need to keep their opinions to themselves. It's none of their business.

Now, let's get on with threads where someone wants to listen for a change. :rolleyes:

Well, I was under the impression that an adoption was necessary. Apparently, I was wrong. There are cases in which you can lose your rights and still have to pay support. Because you lose your rights not your obligations. However, I think, I am not sure, again you should ask a lawyer, I think that if her husband adopts the child you are absolved of your financial obligation as he will be come the legal father of the child. The only reason, in my opinion, your ex would not wish for her husband to obtain all legal rights to the child is if as you said she wants to continue to collect child support from you. Call her talk to her about it see where her mind is at as politely as possible. Regardless of whether you want to or not ignoring this issue is not going to make it go away.

Keep calling names and I will turn you in... Everyone is entitled to their own opinion just because you don't agree with that opinion doesn't make that person and idiot..

About time someone has brought that to BB's attention. He's rude with his name calling and Actually, the courts have proven paternity for this guy, read closer...Mom took him to court for child support and an order was granted and so was paternity!

This is NOT an opinion site. It's about law. And you are consistantly telling people here your OPINION which matters not one bit. So, until you keep your mouth shut and learn what the difference is between the law and your opinion then I'll continue to show how stupid your comments are...and how dangerous if taken as more than and idiot opinion.

And your contribution is just as worthless. You obviously can't read. The poster said mom took him to court for support. Now tell me where the ORIGINAL POSTER said there is an order for child support from the court.

I'll wait.......oh I'm sure you can find that part of the poster's words, or not...because THEY DON'T EXIST. Now pay attention, even you might learn something.

To MSDAD: First, come back here and answer this question: Did the court order child support or do you voluntarily pay it?

Now, as to visitation. You are this child's father, but with no rights until you get off your pity party and start demanding them. That includes filing for visitation AND filing a petition to deny the name change. File for custody.

Dang and here I thought BBreeze was being nice compared to his normal lol Oy so go ahead and report him they might just lock this thread that has went on wayyyy to long and then we would all be saved the misery of it continuing! And him callin this guy an idiot was way to nice a term. I was hoping BBreeze would give him what he deserved! Sighhh BBreeze don't you know that you are supposed to post what we all want to say but dang it just can't get past our old fashion raising to do it. Dont start slacking on me now! :D

BB... I took this:

At the time it was too much for me to deal with. I had other problems then. Two DUI's and I wasn't sure the baby was mine. I found out when he was 6 months. But she was taking me to court for child support and I told her once it was proven that he was mine, I would set up a fund for him that HE COULD HAVE, NOT HER when he turned 18. But she took me anyway, and at the time I was angry with her for it.

to indicate that there is, in fact, court-ordered CS.

If you're that concerned about this threads length perhaps you should skip it from now on. Oh yeah and the "he" you keep referring to is a SHE
