Let your insurance companies handle it, that is what you pay premiums for. Just because the police officer couldn't determine if a citation should have been given, doesn't mean the insurance companies won't settle.

You should have had GAP insurance. The other driver was only responsible for the fair market value of your car. It was not their fault that you owed more on the car then it was worth.
