If you did file a claim with him in small claims court, the pictures could be used to show you were aware of the cuts before the purchase.
I think the OP intent is based upon principle and legality of the bid on eBay. In the long run the OP would be further ahead to get their final value fees refunded, eat the listing fees from eBay and re-list the item.

I am not an attorney, but if you fight it, I wouldn't tell the judge you stopped three feet after the sign. Because technically that is in violation of the state motor vehicle code, and you just admitted guilt.

How did you not do it intentionally? Unless something accidentally slipped into a bag you were carrying (which is the oldest story in the book) it has to be intentional.
