I think
I think that when you pay her it will end. The reason I think this is because of the notice to pay or leave. They can refuse payment and go ahead with eviction but I really honestly think that when you pay it will stop and Never Never Never give a landlord cash with out a receipt. I do...
What is the name of your state?Ore
Can anyone tell me what the difference in being a junior member, member and senior member here? Is it based on how long you have been here or the number of posts? I know this sounds dumb but I am curious :D
Sounds like
It sounds like to me depending how long you lived there that the landlord is charging you for normal wear and tear which he may not be able to do (not sure of CA) and if he is then it is illegal. Take him to small claims court. sounds like he wants free money. IMO too many landlords...
That's lousy
I misjudged you from your first post. a lot of people get behind because they buy toys instead of paying rent or just don't pay it. Sounds like even though this effects you big time that it is just a bad setback. hope everything goes ok with you and the person hurt. does Landlord...
Translation
It means to either pay your rent or leave and if not leaving show cause to why so in your case. I am sure it means pay or leave and if you pay you can stay. However ask your Landlord? also you will probably have to pay back the $40.00 filing fee. if landlord doesn't ask for it offer...
You could
You could try to call police and at least file a police report but you will probably have to take him to small claims court for damages plus he probably broke your states landlord and tenant law.
Do you honestly think
Do you honestly think that if you evict this person that a new tenant will put up with it. If I was your tenant and you even tried to evict me over this you would be staring at the inside of a courtroom.
Witness's
Did the witnesse's see you give her any rent money? or can people testify to her character because chances are she has done this before to someone else. if you have a bookstore such as Borders etc in your area please get your self a landlord and tenant book for your state. They are...
Hope this helps
you will probably have to sue where the rental is located because it happened there. Do you have contract with property manager. if so maybe you could get them for breach of contract. I would check to see if the state where this is going on has a realtors board (not sure if they...
I just thought
I just thought that if she went to mrlandlord that there was links for laws for each state plus if she didn't believe anyone here she could ask someone who knows the laws like long term landlords etc.
What discrimination?
What discrimination? he is a criminal and the landlord doesn't want him around of course it would help if you told us what he was convicted of. If your landlord lets him stay then he is putting at risk other tenants possibly and also leaving himself liable to be sued by...
Re-small claims court
That other poster is right. if she doesn't show up then you win by default judgement. but most states require that the person be served before you can sue them and win a judgement.
Small claims
You could take her to small claims court but if she is not working then it will be useless. but if you do take her to court. then if she does work then you could try to garnish her wages. but to be honest you probably will not collect a dime.
I understand
The renters insurance will cover any damages that you do or a pet. It will also cover you if a fire happens because if a fire happens the landlords insurance does not cover your belongings. Allot of tenants find that out too late. now on what she did she was responsible not you. I...
make sure you
You should also mail her a copy of notice and send it certified return receipt because she has to sign for it and the receipt is proof she got notice in case this goes to court. I would get rid of her she is going to continue to cause you problems. for help and advice to make...
You have a problem
If you have not receipts or proof then it will be next to impossible for you to win. if it goes to court. courts tend to side with the LL's. Also in the future if a LL demands cash for everything do what I do tell them you will give them the cash when they cough up a receipt...
not paying rent
When a person lives in a house/apt without paying the landlord rent it is stealing not to try to pay him. after all your landlord has bills of his own because of your place should the govt give his free tax break because you did not pay him. even though your husband lost his job...
go to this site for help
Go to mrlandlord.com they have all the help you need like forms, advice, forums and there is landlords with years of experience that can help you out. also please for your own protection go to a bookstore and purchase a landlord tenant law book and study the laws...
You got it
you could ask him to leave but if I were you I would do it 100% legal and use the court system if he doesn't leave. My exlandlord did it illegally and I am going to fry her in court soon. She hasn't a prayer of winning and I am going to be laughing when she fries. I told my...
Sounds like
Sounds like the old judgements keeps getting renewed by LL. Since you were underage when contract was signed. Does the co-signer have a judgement on them. if not this judgement could be illegal since you were a minor at the time. also sounds illegal because I know in my state that...
