Can you explain further what you are trying to word here about inconsistency?
IMO... Just make it a little more clearer by stating that any visits to extended family (ie..grandparents, etc) would have to be scheduled on that parties parenting time and will not conflict with the current...
From FL's DOT site
All children 5 years of age or younger must be properly restrained no matter where they are sitting in the vehicle. Children through age 3 must be secured in a separate carrier or a vehicle manufacturer's integrated child safety seat. For children aged 4 through 5 years, a...
Generally, when it turns into a He/She said argument the contempt charge doesn't stick especially when it's petty. Depends on the judge.
Depends on the judge
Depends on the judge. In my DH's case, Yes.
No, DH's Ex tried that with us as well.
That will not look bad on her. How can you say that? She has visitation.. this was her visitation weekend and more then likely a judge will slap the CP on the wrist for allowing the child to make a decision. UGH!
IMO.. forget the he said/she said stuff...forget trying to file anything...
Keep in mind that this is JMO!
I am going through a Custody Mod right now... I have opened up "Pandora's Box" fully and am regretting it to some degree.
Even if you take her back to court for CS... say they order her to pay on her old wage... do you think she is going to pay it? She hasn't...
Did the Police give you any paperwork?
If you have read many of the posts on here you will hear time and time again that children cannot choose what they want to do in regards to visitation if you are following your court order.
You need to document and file a contempt charge.
You need to go back and read the original post. BM is not contesting paternity so it doesn't have to be proven. She wanted advice on how to handle the visitation when he has a restraining order against him for 90 days and he is just showing up at the door.
He can't do that with a restraining...
House Rules!
Plain and simple... these are the house rules (no cell phones). There is a landline to be able to make phone calls from (although not as trendy, it does still work).
Unless she wants to take it back to court and spend more money fighting the issue of cell phones then cell phones...
She stated: "My son sees him Thurs. overnight , Fri over night and every other weekend. We also split all holidays equally."
Liberal is open visitation... but wouldn't status quo be in order in this situation?
FYI... it's not just the "father's" that have to go through this.. be careful on your wording :)
It may seem to be petty now the things that you have to go through, time consuming, spending money, and disappointment. But, each time you file a police report and each time she changes what is...
Just another idea....
If you have family in a different state.. nothing states that you can't go visit that relative for a little while right? At least until he goes to court for the charges that you filed with the car incident. Possibly since he has priors then he will do some time.
But...
Just curious... how can you file contempt on something that doesn't have a court order (not even a temporary order) because neither parent has custody until they go to court?
Is BF on the birth certificate.. has he established paternity?
I really don't see why a call has not been placed to CPS if either of you expect abuse. That is a no brainer there. If anything, CPS goes out and visits and if they don't find abuse or neglect then BF would have some type of piece...
